How Should I Record My Medical Bills?

How Should I Record My Medical Bills?

Charlotte, NC Personal Injury Lawyer

Many people who have been injured in an accident do not understand how important it is to keep complete and accurate track of their medical bills.  Your Charlotte medical malpractice attorney will need your full records to get you the best deal possible.  You should, at a minimum, take the following steps:

  1. Get a bill every time you go to a doctor, hospital, or other medical facility.  This includes less traditional medical treatments, such as a physical therapist.
  2. Keep all of your prescription bills for medication related to your injury.
  3. Put together a chart that tracks your medical bills and medication purchases along with the dates for each.  You should know how much was paid and by whom (i.e., by you, your insurance, or your employer).
  4. Give a copy of all bills that are related to your injury or recovery to your Charlotte medical malpractice attorney.  This is important to ensure you receive the highest amount of compensation possible.
  5. Even if your bills are paid for by health insurance or your employer, keep a record.  The more information you have to personally give to your lawyer, the better your settlement will likely be.

How Can I Pay My Medical Bills?

Charlotte NC Auto Accident Lawyer

You and your Charlotte auto accident lawyer should sit down to go over your medical bills and how best to pay them.  Usually, medical bills are paid in the one of the following ways:

1.      Health Insurance – You may have health insurance from a number of sources, including an employment benefits package or insurance that you purchased on your own.  You may also be covered by your spouse’s or parents’ plan, depending on your age.

2.      Medical Payments Insurance – Many automobile policies include coverage for injuries caused by automobile accidents.  If you were driving, your own insurance may cover your expenses.  If you were a passenger, the driver’s policy may still cover you.

4.      Workers’ Compensation – If your injury was caused by your employment and was incurred while working, you may be entitled to worker’s compensation.

5.      Liability Insurance – If your injury was caused by another person or company, you may ultimately recover your medical expenses from their liability insurance.  Unfortunately, you will likely not be paid until you settle the case, which can take a significant amount of time.

Help to Prevent Dog Bites

Charlotte NC Dog Bite Lawyer

Every day, around 1,000 people just in the U.S. require emergency treatment for dog bite injury.  According to the Center for Disease Control  by following the list of considerations when looking to get a dog and things to do when you have a dog can help prevent dog bites.

Things to Consider:

  • Consult with a professional (e.g., veterinarian, animal behaviorist, or responsible breeder) to learn about suitable breeds of dogs for your household.
  • Dogs with histories of aggression are inappropriate in households with children.
  • Be sensitive to cues that a child is fearful or apprehensive about a dog and, if so, delay acquiring a dog.

When the Insurance Company Won’t Settle

Charlotte, NC Personal Injury Lawyer

Some insurance companies are highly resistant to the idea of settling. From the outset it is important for you and your personal injury attorney to determine how strong a case you have, and whether it will be worth litigating if that becomes necessary.

Why Some Insurers Won’t Settle

Certain insurance companies simply have a philosophy that they will not settle injury claims without a protracted battle. These are often the large, multi-state corporations, which tend to be very conservative about settlements. They may even fight against settling a case whose value is small and has substantial evidence in its favor.

Your Charlotte personal injury attorney likely knows which insurance companies fall into this category, but the defense attorneys can be the ones who dig in their heels, too. These attorneys make their money by dragging cases out and litigating them, not by commission.

The Nature of Your Injuries

Another reason insurers may be less than enthusiastic about settling is that they feel your attorney will have a difficult time producing proof of your injuries. Certain injuries are difficult to quantify using conventional medical techniques such as X-rays. These are soft tissue injuries such as back pain and whiplash—the kinds that often need treatment by a chiropractor.

Relatively few personal injury cases are taken to trial. Insurers know that, unless a case is well-documented and has potential for a large settlement, personal injury attorneys are unlikely to litigate them. This is not meant to discourage you from seeking compensation for your injuries. You just need to be aware of what you may be facing with intractable insurance companies.

After Your Case Is Settled

Charlotte, NC Personal Injury Lawyer

It is difficult from early on to make an accurate estimate of how long it will take for your case to be decided. Much depends upon the willingness of the insurance company to negotiate with your injury lawyer.  If the case goes to trial, completion of the case may be delayed for quite a while.

But what happens when, at last, that big day comes?

After the Trial

Assuming your case is taken to a jury trial, and the verdict falls in your favor, generally 3-4 weeks are necessary to complete the paperwork. During this time your Carolina injury lawyer will work with defense attorneys to finalize court costs and attorney fees. These will be deducted from the final settlement amount you receive.

In Case of an Appeal

There is an outside chance that the defense will appeal the verdict. If this occurs, your settlement will be delayed.

If you lose the case, there may be grounds for an appeal on your part. Your lawyer will discuss whether this is an avenue worth pursuing. It may be that an appeal will eat away so much of any potential settlement that it simply doesn’t make financial sense.

Once in a great while a defense insurer will offer a small settlement to a party that loses a personal injury claim. This is highly unlikely to occur, however. Your focus should be entirely upon winning your case.

When Your Charlotte Personal Injury Lawyer Takes Your Personal Injury Case

Charlotte, NC Personal Injury Lawyer

Once your Charlotte personal injury lawyer meets with you and accepts your case, he will need to gather information and investigate the details of the accident. You can expect that he will call upon you to assist with matters from time to time as necessary. Your main job at this point, though, is to do all you can to heal.

Information Gathering and Investigation

Your injury lawyer will need to get copies of the following:

  • The police report
  • The medical report from the doctor/medical center where you were initially treated
  • All subsequent medical reports
  • Your medical history
  • Medical bills

Your lawyer will also need to interview and take statements from witnesses and visit the scene of your accident. He may hire a private investigator for this. In addition, he will need to review appropriate case and statutory law.

Contacting the Insurance Company

Assuming that the defendant has an insurance company, your lawyer will initiate contact and determine how much coverage exists as a source for obtaining a settlement. This contact also serves to let the insurance company know that you are now being represented by a lawyer.
