Hybrid & Electric Vehicles Making Roads Safer?

Hybrid & Electric Vehicles Making Roads Safer?

Fort Mill SC Auto Accident Lawyer

There are  new laws continuously being established across the country to help ensure the safety of motorists, bicyclists and pedestrians. Laws have been established in North Carolina and throughout the entire country to prevent drivers from operating their vehicles while being distracted by cellphones or require the use of a seat belt to protect drivers in the event of a crash.

In another effort to increase safety on the road, the National Highway Traffic Safety Administration recently suggested that automakers should make hybrid and electric vehicles louder so that other motorists, pedestrians and bicyclists can hear the vehicles on the road. When pedestrians and bicyclists are on the road, they may be able to avoid being hit by a vehicle when they can hear that a vehicle is approaching.

The NHTSA is recommending that hybrid and electric vehicles be designed in a way that would make the vehicles emit louder sounds when traveling at speeds below 18 mph. This change could prevent more than 2,500 injuries over the life of each model year of vehicles, the NHTSA claims.

Adding sound-producing technology to the vehicles would entail installing speaker systems. Auto manufacturers would also be able to choose whatever sounds they want to have the models emit. And the cost of adding the technology to vehicles is relatively low.

Some automakers have already begun adding speakers to vehicles in order to make their vehicles safer for all who are on the road. The Chevrolet Volt allows the driver to activate a warning sound using a button on the end of the turn signal lever, while the Nissan Leaf plays a sound at speeds of up to 18 mph.

The NHTSA’s proposal has not been approved yet.

Fatal Summer Accidents

Fort Mill SC Auto Accident Lawyer

Summer is a favorite season for many people, but students in particular have reason to find it especially enjoyable. With school being out for 3 months and warm summer temperatures, most teens are spending their days driving to somewhere like the beach or to a friends house. With the increase of teens on the road summertime fatal accident numbers jump to staggering heights.

The National Highway Traffic Safety Administration’s data shows that summer months are the most dangerous for teens.

On average, 422 teens nationwide are killed in car wrecks during the summer months, which is an average of 140/month for the 3 months of summer break. That number is shocking given that only 363 teens die in car accidents during the other nine months of the year, which equates to an average 40 teens each month. During those summer vacations an additional 100 teens are involved in fatal accidents.

The reasons why are not difficult to determine — teens often stay out later in the summer and are more often traveling in groups. Moreover, teens are considerably less experienced drivers than adults. In more recent years, the danger has been compounded by young people’s cell phone use while driving, and last year marked the first increase in teen driving deaths after eight years of declines.

Medical Malpractice Claim Issues

Charlotte NC Medical Malpractice Lawyer

Motor vehicle accidents caused by reckless or distracted drivers are happening daily across our nation, causing innocent victims to suffer injuries or worse. According to a 2011 report, folks may actually be more at risk of suffering serious or fatal injuries at the hands of a negligent doctor rather than a negligent driver in North Carolina. According to a news report, more patients die from incidents of medical malpractice compared to the number of motorists who die in traffic accidents each year in our state.

Serious or fatal medical mistakes can forever change the lives of victims and their families. Victims could suffer permanent injuries and no longer have the capability of returning to work or living on their own. Families often suffer emotional pain, knowing that a loved one’s death or injuries could have been prevented. But families also suffer financial consequences, especially when the victim is a family’s primary wage-earner.

When considering the physical, emotional and financial effects a medical mistake can have on a  patient and their family, folks might assume that they of all people are entitled to receive compensation for their injuries, pain and medical expenses. Unfortunately, this is not always the case in North Carolina.

Last year, Senate Bill 33 took effect. This bill caps non-economic damages in medical malpractice cases, prohibiting damages for emotional pain and suffering from exceeding $500,000 for patients and their families. This bill also gives more protections to doctors rather than patients.

Current laws may make it difficult for victims to pursue medical negligence claims on their own. But with the help of an attorney who will aggressively protect the rights of patients and their families, medical malpractice victims may have a better chance of receiving the compensation they need and deserve.

Richland County Fatal Accident Toll

Rock Hill SC Auto Accident Lawyer

We are over half way through 2013 and Richland County maintain its sad distinction of being the top county out of 46 with the highest number of people killed on its roads.

As of midnight Sunday, 27 people had died on Richland’s roads, according to the S.C. Department of Public Safety.

Greenville County, which has the second highest death toll, has 22. Lexington County has only 13.

Richland’s sky-high total includes the latest traffic victim, a 44 year old man, whose battered body was found Saturday on a Forest Acres street on Saturday night. He was fatally hit by a vehicle and kept on going.

A tip is when your walking at night,  wear light colored clothing, reflectors and walk against traffic. This will help not only the pedestrian but make you more visible to drivers on the road.

Large contributors to these fatal accidents can be avoided by not driving without seatbelts and driving while intoxicated.

Other counties’ death tolls: Kershaw, 9; Horry, 18; Fairfield, 0; Aiken, 15; Florence, 17; Orangeburg, 13; Calhoun, 2; Spartanburg, 15; and Sumter, 9.

Why Not to Settle With All Insurers

Rock Hill, SC Personal Injury Lawyer

It’s rare for some insurance companies to fairly settle small to medium range personal injury cases unless you file suit and perhaps even go to full trial. In these instances, without filing suit, it is likely a waste of your time to attempt to reach settlement with these insurance companies. A skilled Charlotte medical malpractice attorney can assist you in determining the best course of action.

Consider Litigation

These types of insurance companies will give you little choice but to pursue litigation. They respond to litigation. They respond to verdicts. Your Charlotte medical malpractice lawyer can assess how the insurance companies will respond to your particular injury.

Certain situations will not garner much for your suffering. Examples include:

  • If you have a soft tissue injury case with injuries undocumented by objective medical evidence
  • If your injury involves considerable chiropractic treatment

In such instances, the claims adjuster will painstakingly scrutinize every detail in your file. If even the tiniest question of liability arises, the insurance company’s offer will not surpass your medical bills and lost wages. It may even be less.

It would be futile for your personal injury attorney to attempt a fair settlement offer using calls, letters, evidence, and settlement brochures. A more practical approach for your attorney may be to begin the lawsuit following the initial investigation and preparation. Charlotte medical malpractice attorney can guide you in making these tough decisions.

Your Lawyer Should Know How to Litigate

It’s important to recognize that a personal injury attorney, above all else, should know how to litigate. An attorney is successful when he or she has a proven record of settling cases for maximum damages, which can only be achieved by possessing a talent for litigation. The alternative—a “settling” attorney—will be offered lower settlements than an attorney who is a demonstrated litigator.

MRI to Assist in Treating Post Concussion Syndrome

Rock Hill, SC TBI Lawyer

There has been new research that shows how the brain is changed in a person who suffers form post-concussion syndrome. These findings are from a new study published online in the journal Radiology.

A concussion is a type of traumatic brain injury that alters the way your brain functions. Effects are usually temporary, but can include problems with headache, concentration, memory, judgment, balance and coordination, light sensitivity and more.

Many concussions are usually caused by a blow to the head.  But they can also occur when the head and upper body are violently shaken in a very short period of time – milliseconds. These injuries can cause a loss of consciousness, but most concussions do not. Because of this, some people have concussions and don’t realize it.

Concussions are common, particularly if you play a contact sport, such as football. But every concussioninjures your brain to some extent. This injury needs time and rest to heal properly. Luckily, most concussive traumatic brain injuries are mild, and people usually recover fully. However in making that statement one must acknowledge that there are a percentage – 15-25% – of concussions that do not fully recover.

Post Concussion Syndrome affects approximately 20 percent to 30 percent of people who suffer mild traumatic brain injury (MTBI) — defined by the World Health Organization as a traumatic event causing brief loss of consciousness and/or transient memory dysfunction or disorientation.

Conventional neuroimaging cannot distinguish which Mild Traumatic Brain Injury patients will develop Post Concussion Syndrome.  “Conventional imaging with CT or MRI is pretty much normal in Mild Traumatic Brain Injury patients, even though some go on to develop symptoms, including severe cognitive problems,” said Yulin Ge, M.D., associate professor, Department of Radiology at the NYU School of Medicine in New York City.

For the new study, Dr. Ge and colleagues used resting-state functional MRI to compare 23 MTBI patients who had post-traumatic symptoms within two months of the injury and 18 age-matched healthy controls. Resting state MRI detects distinct changes in baseline oxygen level fluctuations associated with brain functional networks between patients with MTBI and control patients.

The MRI results showed that communication and information integration in the brain were disrupted among key DMN structures after mild head injury, and that the brain tapped into different neural resources to compensate for the impaired function.

Findings like these will make it easier to detect, identify and treat people who fall into the mild traumatic brain injury category.  And it will make proving the injury and its affects easier.

Fatal Accident Brings Family to Sue a Sorority

Charlotte, NC Wrongful Death Lawyer

It has been almost two years since a North Carolina woman learned that her daughter had been killed in a car accident. The woman’s daughter was with several friends when their car was involved in a one-vehicle wreck. One of the daughter’s friends had been driving. The driver was tired and fell asleep behind the wheel.

The driver and one passenger survived the Nov. 20, 2010, crash. However, the woman’s 20-year-old daughter suffered fatal injuries in the accident and another passenger died from her injuries the day after the crash. Now, the mother is hoping that she will be able to prevent other families from having to experience the tragic loss of a child. The woman has already filed a lawsuit against the driver for negligence, but it was reported this week that the mother is also filing a wrongful death lawsuit against a sorority for the group’s involvement in the fatal accident.

The North Carolina mother may be eligible to obtain compensation for damages resulting from her daughter’s death, but she also wants to make sure that changes are made so that no mother has to lose a daughter under similar circumstances. According to the wrongful death lawsuit, the driver of the vehicle had been so exhausted because she was trying to join a sorority and was participating in hazing activities.

The woman’s daughter and several other women were trying to join the Delta Sigma Theta sorority at East Carolina University. Although hazing was in violation of the school’s policies, the sorority subjected pledges to various forms of hazing anyways.

The lawsuit claims that more than a dozen pledges were deprived of sleep as a result of hazing. The women were forced to share a small living space together and perform numerous physical activities. After days of little sleep, the women were then told to show up for 6:30 a.m. hair appointments to get ready for their induction ceremony. When several of the pledges, including the woman’s daughter, were on their way to their appointments, one of the pledges fell asleep while driving and crashed their car into a tree.

The mother is asking that the sorority be held partly responsible for causing the fatal accident. Hopefully, this tragic accident will encourage other sororities to focus on the safety of their pledges rather than to put their pledges in dangerous and potentially fatal situations.

A Charlotte Auto Accident Attorney Discusses Adjuster Tactics: Activity Checks

Charlotte NC Auto Accident Lawyer

Insurance adjuster will often engage in underhanded tactics in order to disprove your claims. An experienced Charlotte auto accident attorney will combat these tactics and protect your rights and privacy.

Adjusters as Private Investigators

Although claim adjusters are not private investigators, they may visit your neighborhood and prod your neighbors for information regarding your claim, such as your physical well being and alleged disability. A Charlotte auto accident attorney will explain that this is referred to as an “activity check,” or a “sub rosa investigation,” which is a variation of an undercover investigation.

An adjuster conducting an activity check will ask the neighbors the following kinds of questions:

  • “Have you seen Mr. Smith performing extensive yard work?”
  • “Does Mr. Smith spend a lot of time doing maintenance on the car?”
  • “Does Mr. Smith seem to be in pain when he uses the lawnmower or takes out the garbage?”
  • “Is Mr. Smith usually physically active?”
  • “Did you know that Mr. Smith was recently injured and is now disabled?”

Your Charlotte auto accident attorney should assure you that such questions are not damning or admissible per se. But adjusters will be actively looking for any “red flags” in the neighbors’ response regarding your claim. If they inform the adjuster that you seem physically active, he or she will have several options to explore the claim further, including hiring a private investigator.

Why Adjusters Will Turn to Private Investigators

Any Charlotte auto accident lawyer knows that an adjuster will need more than witness accounts to seriously undermine or deny your claim. He or she realistically needs photographic or video evidence of you performing physically demanding activity, which effectively disproves your disability claim.

However, adjusters usually cannot afford to spend long hours in a hot surveillance van to obtain such evidence. Therefore, they will rely on a professional surveillance firm to do the work for them. Your Charlotte auto accident attorney will therefore advise you to exercise discretion when you are out in public.

Motorcycle Fatalities Increase as Summer Approaches

Rock Hill SC Motorcycle Accident Lawyer

As summer quickly approaches and kids are out of school for the summer, our roads will quickly fill up with more traffic. With more traffic on our roads the risk for an accident is that much greater, especially for motorcycles. Motorcycles often go unseen on the road until a vehicle makes contact with them on the road.

In just a 4 day time span Rock Hill experienced one fatal motorcycle crash and another critical injury crash.

The fatal accident occurred when the man was ran off the road, struck a ditch and was thrown from his motorcycle while not wearing a helmet. The man was pronounced dead at the scene.

Just a few days later another local motorcyclist was critically injured in a hit-and-run incident. The men who hit the motorcyclist were later found and charged with leaving the scene of an accident.
