Swimming Pool Accidents

Swimming Pool Accidents

North Carolina Personal Injury Lawyer

Swimming pool accidents claim 10 lives a day. Of these fatalities on average, two are usually kids who are younger than 15-years-old.

Drowning ranks fifth among the leading causes of unintentional injury death in the country. During the summertime, residents and visitors are outside and the period between July Fourth and Labor Day is the height of the swimming season. Children are outside splashing around in the pool, and playing with their friends. The number of drowning accidents typically skyrockets during this time of the year, too.

Parents and guardians are warned now: never take your eye off children when they’re playing in our around a pool, make sure that your pool is child-proof, and make sure that you take all of the proper safety measures.

From 2005 to 2008, there were nearly 4,000 people who drowned (non-boat-related accidents) in the U.S. About a fifth of these victims were young children. For each child who dies, another 5 are sent to emergency rooms and treated for related injuries, which can often result in life-changing conditions. Traumatic brain injury is a leading cause of long-term injury in near-drowning accidents, according to the Centers for Disease Control and Prevention.

About half of all of the victims of drowning accidents who are treated in an E.R. require further hospitalization or must be transferred for further care. Some of the most severe consequences of these kinds of accidents can be permanent learning disabilities, permanent memory problems as well as a permanent loss of basic functioning.

Swimming Pool Safety Tips from the North Carolina Department of Public Safety:

  • Make sure that your pool at home is completely fenced in. Make sure that the fence doors are locked whenever there isn’t an adult nearby.
  • If you use a cover on your pool, make sure that it’s completely covered every time.
  • If you cannot find your child, you should look in the pool first.
  • If you have an above ground pool, remove steps and ladders when the pool is not being used.
  • Always keep rescue equipment nearby.
  • Keep a cell phone or a house phone nearby at all times for quick access in the event of an emergency.
  • Consider learning First-Aid and CPR to be able to help victims while emergency response teams arrive at an accident scene.
  • Always supervise swimming children.
  • Never substitute flotation devices for supervision.

A Charlotte Wrongful Death Attorney Discusses When It Is Appropriate to Hire Counsel

Charlotte, NC Wrongful Death Lawyer

When you decide to hire an attorney in a personal injury case may raise red flags to claims adjusters. Whether it is fair or not, claims adjusters are often suspicious of people who are quick to hire a personal injury attorney at the beginning of a claim. A Charlotte wrongful death attorney can attest that adjusters typically like to get a chance to work with an injured person before attorneys get involved.

Adjusters can justify the retention of counsel appropriate if the parties can’t reach an agreement or there is a dispute over the value of a claim—however, not before an adjuster and claimant work together first. A Charlotte wrongful death attorney can explain that letters of representation dated the same day or the day after the accident look suspicious to adjusters. Some claimants have reached out to lawyers while still at the scene of the accident. These types of behavior will likely compel adjusters to further investigate prior claims history, search medical records for inconsistencies and possibly take a longer time to handle the claim.

Adjusters Take Note of Claim Consciousness

Adjusters make mental notes of those claimants who seem to know a lot about making claims. Adjusters often search the Central Index Bureau, which reveals the number of past insurance claims for personal injury claimants, to see if the claimant has a history of personal injury lawsuits, workers’ compensation claims or other injury claims. A claimant who is overly enthusiastic about settling may also leave the adjuster questioning the validity of the claim.

A Charlotte Personal Injury Attorney Explains When Adjusters Question a Claim’s Validity

Charlotte, NC Personal Injury Lawyer

Claims adjusters often look very carefully at people in any occupation who could potentially benefit financially from an accident or injury. A Charlotte personal injury lawyer can tell you that ambulance drivers, because of their medical knowledge and legal connections, learn very early how to add weight to a claim. These drivers often refer cases to law firms where they have made connections. Nurses and doctors are often scrutinized the same way, due to their wealth of medical knowledge.

Unions, Police and Rental Vehicles

Any occupation that endows someone with increased knowledge regarding auto accidents or injury cases, and therefore increases chances of making money from lawsuits, are investigated thoroughly by claims adjusters. Sometimes, attorneys let the police know how much could be made if a lawsuit is filed.

A Charlotte personal injury lawyer can also explain that union members, who are often referred to one or two specific law firms that repeatedly appear on behalf of iron workers, truck drivers and other union members, also are evaluated closely. Many times, these special law firms refer clients to personal injury medical experts who give attorneys treatment, reports and testimony that are skewed to benefit them.

Claims adjusters also pay close attention to rental vehicle accidents, because oftentimes such accidents they are one-vehicle collisions that occur in remote areas with no witnesses. An accusation of unsafe vehicle or improper maintenance may result in a case against the truck’s manufacturer, equipment and its owner.

Possible Treatment for Traumatic Brain Injuries

Rock Hill, SC TBI Lawyer

Traumatic brain injuries are considered to be incredibly difficult to treat for neurological doctors. Recent discovery shows that a drug, known as metformin, which is used to control Type 2 diabetes triggers stem cells into producing new brain cells, bringing hope of a new potential treatment for brain injuries.

Researcher at Toronto’s Hospital for Sick Children performed a study showing the drug metformin helps activate the mechanism that signals stem cells to generate new neurons and other brain cells.

The researchers used lab-dish experiments that used both mouse and human brain stem cells. Mice were given learning and memory tests after being given metformin.

Initially, researchers added metformin to stem cells harvested from the brains of mice. When that proved successful, they repeated the experiment with human brain stem cells that were generated in the lab. Both cases resulted in the mice and human stem cells creating new brain cells.

The drug was then tested in lab mice, with the result being that the mice receiving daily doses of metformin for two to three weeks had increased brain cell growth. In addition, the mice outperformed other mice that did not receive the drug in memory and learning tasks.

The researchers say that metformin extensive safety record means that it is an ideal drug to use in tests and trials for regrowth of brain cells. The drug may be especially beneficial to pediatric TBI patients. A pilot study is awaiting approval, and may begin within the next year at the soonest.

A Charlotte Medical Malpractice Lawyer Discusses Damages for Pain and Suffering

Charlotte NC Medical Malpractice Lawyer

Pain and suffering, medical bills, lost wages and property damage all factor into the amount of money that gets paid out on a claim. As your Charlotte medical malpractice lawyer can advise you, pain and suffering is properly documented through medical records that outline the treatment and physical pain you endured.

Use and dosages of any prescription pain or anti-inflammatory medications should be well-documented. Information submitted to the insurer should include whether you continue to take the medicine, or if you stopped using painkillers, what length of time you were required to use them. You should also include whether your injuries had any temporary or permanent impact on the range of motion for any body part. In a number of states, you can collect damages for additional pain and suffering if a pre-existing medical condition worsened following an accident.

Past, Present and Future

Insurance adjusters typically require documentation to prove a pain and suffering claim. For instance, the adjuster would need a statement from your doctor and employer if your alleged pain from the injury caused you to miss work. As your Charlotte medical malpractice attorney will tell you, any settlement offer or payment should take into account past and future pain and suffering.

Common Birth Injuries

Charlotte NC Birth Injury Lawyer

A birth injury or trauma during delivery is an injury that happens to a baby during birth. Delaying the delivery of a baby can cause profound injury to a child due to oxygen deprivation. These injuries include brain damage, cerebral palsy, erbs palsy, and other physical and neurological injuries.

Common birth injuries:

  • Caput Succedaneum: A severe swelling of the soft tissues of the baby’s scalp that develops as the baby travels through the birth canal. Some babies have some bruising of the area. The swelling usually disappears in a few days without problems. Babies delivered by vacuum extraction are more likely to have this condition.
  • Cephalohematoma: An area of bleeding between the bone and its fibrous covering. It often appears several hours after birth as a raised lump on the baby’s head.
  • Bruising/Forceps Marks: Some babies may show signs of bruising on the face or head simply as a result of the trauma of passing though the birth canal and contact with the mother’s pelvic bones and tissues. Forceps used with delivery can leave temporary marks or bruises on the baby’s face and head. Babies delivered by vacuum extraction may have some scalp bruising or a scalp laceration (cut).
  • Subconjunctival Hemorrhage: The breakage of small blood vessels in the eyes of a baby. One or both of the eyes may have a bright red band around the iris. This is very common and does not cause damage to the eyes. The redness is usually absorbed in a week to ten days.
  • Facial Paralysis: During labor or birth, pressure on a baby’s face may cause the facial nerve to be injured. This may also occur with the use of forceps for delivery. The injury is often seen when the baby cries. There is no movement on the side of the face with the injury and the eye cannot be closed. If the nerve was only bruised, the paralysis usually improves in a few weeks. If the nerve was torn, surgery may be needed.
  • Brachial Palsy: The brachial plexus (the group of nerves that supplies the arms and hands) is injured. It is most common when there is difficulty delivering the baby’s shoulder, called shoulder dystocia. The baby loses the ability to flex and rotate the arm. Many cases of brachial palsy resolve spontaneously in 24 hours or less and splints or therapy are not necessary in these cases. If the injury caused bruising and swelling around the nerves, movement should return within a few months. Tearing of the nerve may result in permanent nerve damage.
  • Fractures: The clavicle or collarbone is the most common fracture during labor and delivery. The clavicle may break when there is difficulty delivering the baby’s shoulder or during a breech delivery. The baby with a fractured clavicle rarely moves the arm on the side of the break. However, healing occurs quickly. As new bone forms, a firm lump on the clavicle often develops in the first 10 days. If the fracture is painful, limiting movement of the arm and shoulder with a soft bandage or splint may be helpful.

North & South Carolina Injury Risk

Charlotte, NC Personal Injury Lawyer

Injuries create medical costs of $406 billion annually and kill one person every three minutes. Sadly, the states of North Carolina, ranking 19th, and South Carolina, ranking 13th, have more people die from injuries than the majority of other U.S. states. This injury data includes injuries from motor vehicle collisions, gun shot wounds, and broken bones.

The state of North Carolina had adult injury-related deaths for Americans with 66 per 100,000 people suffering injury fatalities.  The total lifetime medical costs due to fatal injury in North Carolina were $58.4 million.

The state of South Carolina had adult injury-related deaths for Americans with 71.7 per 100,000 people suffering injury fatalities. The total lifetime medical costs due to fatal injury in South Carolina were $26.3 million.

There are 10 key injury prevention actions, such as strengthening seat belt, booster seat and motorcycle helmet laws, among others and published a listing of the states using some preventative policies. The report offers conclusions that the injury prevention problem has not received as much attention as it warrants.

  • Seat belts saved an estimated 69,000 lives from 2006 to 2010;
  • Motorcycle helmets saved an estimated 8,000 lives from 2005 to 2009;
  • Child safety seats saved around 1,800 lives from 2005 to 2009;
  • The number of children and teens killed in motor vehicle crashes dropped 41 percent from 2000 to 2009; and
  • School-based programs to prevent violence have cut violent behavior among high school students by 29 percent.
While no states adopted all 10 recommendations, California and New York passed nine of them. Some states are concerned about approving some suggestions, fearing perceptions of being overprotective in our individualistic society. However, with 50 million people being treated for injuries annually, more than 180,000 Americans die each year from their injuries. The leading causes of injuries involve the “usual suspects.” Falls, violence, poisonings and vehicle crashes lead the list of injury producers.
