Conservative Insurers – Don’t Mind Lawsuits

Conservative Insurers – Don’t Mind Lawsuits

Charlotte, NC Free Consultation Lawyer

How Different Insurance Companies’ Philosophies Influence Their Claims Adjusters

Clients of a personal injury attorney often ask about the differences between certain insurers and whether it’s easier dealing with some rather than others.

Your Charlotte Attorney Knows Which Carriers Aren’t Afraid of Litigation

The larger, more conservative companies are not concerned about defending lawsuits. They are so large that they won’t have to be overly upset if a Charlotte PI lawyer wins a significant award for a client. For lower level cases, the amount of money is generally not something the company is going to worry about either. It’s worth it for them to mount a defense. For a smaller case, your attorney might be better off negotiating a settlement.

An Employer’s Philosophy Will Influence the Adjuster in Dealing With Your Lawyer

The insurance company wants their adjusters to come to a resolution in as many cases as possible for an amount that is lower than the amounts the employers have authorized. Adjusters are trying to keep the cases as economical as possible and might receive bonuses for superior performance. This will motivate them to get the case over with for a minimal amount.

Large Truck Accidents

Charlotte NC Large Truck / Tractor-Trailer Accident Lawyer

Truck accidents are usually caused by specific acts or failures to follow rules by trucking companies and the truck drivers. An experienced lawyer can help you recognized the unsafe acts or failures to act by the tracking companies.

The cause of truck accidents involving large trucks/autos that result in serious injuries, can usually be blamed on companies and truck drivers because of:

  • Aggressive driving by truck drivers
  • Failure to inspect truck tires, brakes, lights
  • Tailgating by truck drivers
  • Cell phone use by truck drivers
  • Driver fatigue
  • Failure to install blind spot mirrors
  • Jackknifing caused by truck driver’s actions
  • Speeding while ignoring reduced speed limits for trucks
  • Inadequate truck driver training
  • Overloaded trucks
  • Poorly maintained truck brakes
  • Failure to signal lane changes
  • Loss of control – leaving road
  • Loss of retread tires/leaving debris in roadway

Auto occupants are sharing the road with giant trucks. When a wreck between a truck and smaller vehicle occurs, 77% and 86% of those killed are the drivers of the smaller vehicles. (cars, SUVs & motorcycles) There are life-changing, serious injuries to the occupants of the smaller vehicles.

Holiday Travel

Charlotte NC Auto Accident Lawyer

Most people in the Carolina’s have most likely wrapped up holiday shopping. Law enforcement says that during the holiday shopping season, aggressive driving seems to rise. With the increase in tension, police say that car accidents can also rise. But, the potential for car accidents is not eliminated when the holiday shopping season ends. Many people head out onto the roads in the final week of December, leading to New Year’s Eve when party travel can also increase.

Law enforcement agencies send officers out year-round, but in late December, many agencies add extra patrols. The officers are on the road looking for many types of traffic violations. A ticket, or drunk driving arrest, can put a damper on the holiday season. But the ultimate goal for law enforcement during the holidays, all the way through New Year’s, it to reduce the risks for serious car accidents.

Drivers who ignore red lights, or who speed, are a primary concern of law enforcement. The traffic laws are in place to reduce the risk of injury or death. Most people acknowledge that drunk drivers cause far too many accidents each year. But inattentive driving, red light violations and excessive speed (especially on slick and icy roads) also create the danger of great harm.

Law enforcement reminds drivers that alcohol or drugs-even prescription medications-care involved in many injury accidents each year. Inattentive driving, speeding and red light violations can cause serious risk to drivers, their families, and others on the roads all throughout the year, not just during the holiday season.

The traffic safety adviser says that, “People know to be concerned about safety on highways and neighborhood streets, but they forget to be on alert in parking lots.” Pedestrians are often in parking lots and can be severely injured in a slow speed parking lot accident.

Traffic safety issues are easy to discuss during the holiday season, although there is no time of the year that is an appropriate time for people to suffer injuries in a wreck. It is important for all drivers to remember safety issues on our roads.

Outside Airbags to Protect Pedestrians

Fort Mill SC Pedestrian Accident Lawyer

With the advent of hybrid and electric cars and the increased presence of vehicles in highly urbanized areas, the problem of pedestrian accidents has been on the rise around the country. At almost any speed and any place, a walking pedestrian or cyclist’s collision with a car or truck can cause serious and at times even deadly injuries.

In response to a growing trend of pedestrian accidents despite an overall drop in car and truck-related fatalities, the Swedish automaker Volvo announced earlier this month that it will begin featuring airbags placed on the exteriors in its new V40 models, along with a multifaceted internal system designed to decrease the likelihood of a collision between car and walker all in the name of pedestrian safety.

Volvo’s new safety system integrates a grill-mounted radar, alarms designed to center drivers’ attention, and automatic brakes that can bring the car to a stop in the event that a driver does not heed other warnings. Should a crash actually occur, airbags on the outside of the vehicle will deploy outward, softening a person’s impact with the car.

The entire system is designed to be most effective in slow-speed situations, specifically between 12 and 30 mph-the speed window in which most pedestrian accidents occur.

Although the airbag-appointed V40 is not slated for an American release, the move by Volvo is encouraging. Domestic manufacturers will likely seize on the company’s idea and begin installing pedestrian airbags on their own American market models.

All this comes after recent numbers from the National Highway Traffic Safety Administration that reveal a decline in nationwide auto accidents. All told just over 32,000 traffic fatalities occurred in America in 2012. However, the portion of accidents involving pedestrians continues to rise; 16% of those fatalities were outside of the vehicle.

Medical Malpractice: Part 1

Charlotte NC Medical Malpractice Lawyer

When a person visits the doctor’s office or the emergency room of a hospital, they are entitled to receive a certain standard of medical care. Unfortunately, the standard of this “medical care” varies widely from hospital to hospital. In the most extreme incidences, the very hands that are suppose to be helping a patient can ultimately become the cause of their death.

  1. Dana Carvey Bypasses Wrong Artery: In 2001, USA Today reported one of the more well known cases of medical malpractice happened to Saturday Night Live alumni, Dana Carvey. Roughly two months after the double bypass operation that was suppose to preserve his life, Mr. Carvey received the news that the surgeon had bypassed one of the wrong arteries. The surgeon, who performed the surgery, stated that it was an honest mistake that occurred due to the unusual positioning of Mr. Carvey’s artery in his heart. Dana Carvey felt quite differently, and subsequently, he filed a $7.5 million lawsuit against the surgeon and the hospital.
  2. Doctors Perform Heart Surgery on Wrong Patient:It would be quite easy for most readers to dismiss the aforementioned case as an anomaly. Before disregarding its merits, consider the following two cases. A 67 year old woman, who was given the pseudonym of Joan Morris, was admitted to a teaching hospital to have a cerebral angiography performed. After the procedure was completed, Ms. Morris was returned to a hospital room on a different floor than her original one. Instead of being discharged as planned the next morning, she was whisked away to have an open heart procedure performed. After having been upon the operating table for over an hour, a doctor from a different department called and asked what they were doing with his patient. Once the mistake was realized, the procedure was canceled, and Ms. Morris was returned to her room in stable condition; however, the potential consequences of the extra surgery performed included significantly increased risks of heart attack, stroke, internal bleeding and infections.
  3. Surgeon Drills Hole on Wrong Side of Head: In a similar manner, surgeons at the Rhode Island Hospital performed surgery on the wrong side of a patient’s head, for the third time in one calendar year. This particular incident occurred in November of 2007. An 82 year old patient required the operation to stem the flow of bleeding from her brain to her skull. The surgeon immediately started the procedure off incorrectly by drilling a hole on the wrong side of the patient’s skull. This action occurred despite the fact that a CAT scan, performed only moments before, indicated that the bleeding was happening on the left side of the brain. The mistake was caught early on, and the resident surgeon closed the initial hole and proceeded to the correct side of the patient’s head. Although the patient survived the surgery in fair condition, two other similar incidents had occurred within the last year, one of which had resulted in the death of an 86 year old man.

Health of Truck Drivers

Rock Hill SC Large Truck / Tractor-Trailer Accident Lawyer

Under current law, commercial drivers are required to get a physical examination every two years to ensure that they’re fit to operate large motor vehicles. The spirit of the law is to ensure that a detectable medical condition doesn’t cause a driver to lose control or crash a truck or bus and potentially kill or harm dozens of people. However, current regulations allow any doctor to perform the physical – even one who doesn’t practice in general medicine.

Federal officials saw this to be a loophole, as truck drivers could ask their chiropractor or urologist to “sign off” on a medical card certifying the driver to be fit for commercial driving. If one doctor refused to certify a medical card for the driver, he or she could simply shop around until an agreeable doctor would do so.

At the time the law is put into effect, medical cards will be available only from doctors who have undergone a daylong training that educates them about what to look for in truck drivers when deciding whether they’re healthy enough to operate their vehicles safely. The new law will curb doctor-shopping and provide more uniform standards and screening for professional drivers.

The medical issues that certified doctors will keep a special lookout for include:

  • Eye strain
  • Diabetes
  • Chronic stress
  • Skeletal strain
  • Muscular strain
  • Sleep apnea
  • High blood pressure
  • Obesity

Hopefully, the new regulations will decrease the number of truck accidents. Because North and South Carolina are travel hubs, motorists and passengers here are particularly vulnerable to semi truck crashes.

Watch Out for Drunk Drivers This Holiday Season

Rock Hill SC Auto Accident Lawyer

A South Carolina man charged with DUI in a fatal 2011 crash that killed two children has been arrested again and charged with DUI, second offense.

His bond was set at $25,000 and he remained Monday afternoon in the Lexington County Detention Center.

Around 2 a.m. Friday, according to an incident report from the Springdale Police Department, an officer on patrol heard screeching tires coming from a gas station parking lot. When the officer pulled into the lot, he found the man in a vehicle in the parking lot, according to the report. When the officer approached the vehicle and asked questions, the man responded with slurred speech and the officer could smell alcohol.

He failed several field sobriety tests and was unable to follow directions to conduct a blood-alcohol test with a breath test.

Initially charged with felony DUI involving death, authorities later concluded that both parties were at fault. The vehicle carrying the two children and their sibling turned in front of the other drivers vehicle. He was sentenced to three years in prison but was released after 12 months, according to Lexington County court records, and put on three years’ probation.

Factors that Affect Case Value – Your expectations, Witnesses, Venue

Fort Mill, SC Free Consultation Lawyer

Various factors, such as witnesses and venues, can lower or increase the settlement value of your case. A qualified personal injury attorney in Charlotte will work hard to find the best situation for settlement in your case.

A Personal Injury Attorney in Fort Mill Explains How Your Expectations Affect Case Value

If you are a kind of a client who is cooperative and show appreciation for your attorney, your personal injury attorney in Charlotte will be more motivated to negotiate a higher settlement. But even if you weren’t a difficult client with high demands, he or she will likely advise you to temper your expectations since multiple factors, such as comparative negligence and quality of possible medical testimony and supporting witnesses, can affect the settlement value at any time.

A Personal Injury Attorney in Fort Mill Discusses the Impact of Quality Potential Witnesses on Settlement

The effectiveness of lay and expert witnesses’ testimony on liability and damage can significantly affect the settlement value. For example, your case is weak if:

• Your sole witness to support liability is a relative or a friend, instead of impartial witnesses.

• The doctor involved in the case has never testified as a witness, doesn’t want to testify or makes for a poor witness.

Your evidence decides your case, and the quality of your evidence will depend on your witnesses.

A Personal Injury Lawyer in Fort Mill Explains That the Settlement Value Will differ by Venue

Some states, counties and municipalities will produce low verdicts while others will produce high verdicts. According to Jury Verdict Research Inc., Pennsylvania, Vermont, South Dakota, Wyoming, New Hampshire and Maine saw less than 10 $1 million verdicts while states like like New York, California and Florida have had more than 500 verdicts that rewarded more than $1 million.

If your case is small and involves pain, suffering and emotional injuries, jurors in some states might be less persuaded by your injuries, especially if your sustained your injuries three or four years before trial. It will be important for you and your personal injury lawyer in Charlotte to consider your county or jurisdiction in evaluating settlement offers.

Research Collaboration on TBI

Rock Hill, SC Traumatic Brain Injury Lawyer

Peter Chiarelli wants scientists and clinicians working at labs and universities across the country to more actively pass around information and findings concerning advances in traumatic brain injury research.

It is likely the audience at the Kroc Center, assembled for a research symposium on “Advances in Warrior Care,” was listening closely, for Chiarelli has a commanding presence.

In fact, he is the Army’s former vice chief of staff, a retired four-star general who now heads a think tank and project called One Mind for Research. In speaking, Chiarelli wanted to drive home a few central points.

Foremost, he says that, with all the TBI-related research going on across the country, the benefits flowing from it should be more quickly forthcoming. That they aren’t disturbs him.

“I’m not saying to end the way you do things,” he told researchers. “I’m just saying take the next step.”

The next step, he says, is to put down the shields that make research teams closely guard their data and secure all their findings as proprietary. Doing that, he says, flatly closes the door on important research sharing, making advances much slower for head injury victims in both the military and among the general population.

At a time when information can be so quickly and easily shared, Chiarelli argues that the hide-it-until-it’s-published manner of doing things creates a strong disincentive to collaborate.

That must change, he says, and his organization can start the ball rolling. One Mind for Research intends to raise as much as $100 million for TBI research, and Chiarelli says that all the findings will be shared publicly on the project’s website, so that all researchers can benefit and contribute.

“We hope that our portal proves to folks that you can share data and have success,” he told his audience.
