Man Loses Arm in Work Accident

Firefighters rushed to the Barnhardt Manufacturing Company in response to call that a man had his arm caught in one of the processing machines.

The fire department said it took almost 30 minutes for the heavy rescue team to safely remove the man from the machine, he was then rushed to the hospital with life-threatening injuries.

“This was a very technical rescue.  It’s a very tedious rescue, and so firefighters had to take their time.  It’s very meticulous, especially when you are talking about a person who is trapped in a piece of machinery,” said the Capt. of the fire department.

A search of the cotton processing plant’s Occupational Safety and Health Administration records show over the past 10 years federal and state OSHA inspectors have been at the plant seven times.

The company has been cited 35 times for violations. Those violations range from having an unclean work environment to having incorrect belt sizes on certain machines.

Woman Struck by Boat Propeller Loses Arm and Breasts

A 25 year old Charlotte woman was in a boating accident last summer and lost her breasts and an arm. She was seriously injured when a boat propeller struck her during the popular Lake Bash event on Lake Norman.

The 25-year-old claims that while she was in the water the boat’s propeller hit her twice and contends that, the man who was the boat’s operator, never drove a boat prior to that day and he lacked the skill to safely navigate the boat in a crowded, public area. She says that the propeller hit her as the boat operator was trying to tie it to another boat and he had not turned off the engine.

Both the woman and the boat operator had come with a group of friends to the Lake Bash event. According to her, people shouted at him to turn off the engine but he “panicked,” putting the boat into reverse and causing the propeller to hit her. He then placed the boat’s gear in forward and that was when the propeller to hit her a second time.

The victim is also suing the person that the boat operator rented the boat from contending that he should be enforcing safety procedures to his renters. Along with the company that designed, made, and marketed the vessel; accusing the boat manufacturer of continuing to sell the boat even though its design isn’t safe. Scott says that designing the boat so that seven people end up seated behind the boat operator can obstruct the operator’s visibility. Also, she claims that the ladder and platform are located just a few feet from the propeller and the vessel came with inadequate warning signs about possible dangers.

The victim’s injuries were so severe that she had to have her breasts and an arm amputated. She also suffered a severed sternum, lacerations on her legs, and punctured a lung. The accident has left her with serious psychological and emotional problems, medical expenses, permanent injury, scarring, limb loss, lost wages, and other damages.

A midwifes settlement with the family, whose daughter was hospitalized for 21 days after her birth in January 2009 and now has cerebral palsy, was finalized last week and is described in court filings, since a judge must approve settlements reached on behalf of a minor.

A midwife, also the founder of a Birth and Wellness Center, voluntarily surrendered her license in 2010 following an investigation by the state Midwifery Council into a series of complaints about the care she had provided her patients. The complaints alleged that she hadn’t managed cases appropriately, failing to consult with obstetricians about high-risk pregnancies.

The midwife made a statement last winter saying that she stood by her judgment, describing the standard she provided patients as “comparable to any other midwife in the state.”

Although the mother presented several risk factors during her pregnancy, the midwife did not refer her to an obstetrician, nor did she send the mother to the hospital when she was unable to locate the baby’s heartbeat during labor. When their daughter was born and still did not have a heartbeat, the midwife did not promptly call for an ambulance as suggested by the father.

Midwives are not required to carry malpractice insurance to be licensed by the state, although several choose to, said the chairwoman of the state Midwifery Council. She said most insurance companies will not cover a midwife, who does not have malpractice insurance, but “that coverage is optional and each midwife makes the choice for herself.”

A seventeen year old boy, died in a supermarket after a police officer shot him in the chest with a Taser Model X26 electronic control device in 2008. The parents of the boy filed a lawsuit against Taser International for failing to warn law enforcement officials that shooting their stun guns into a person’s chest could cause a heart attack.

The police officer shot the boy in response to reports that he had been yelling and throwing things at the store manager. The officer used the Taser to subdue the boy for thirty-seven seconds. After receiving the shock, he stopped moving. The officer stunned the boy again for five more seconds after he failed to put his hands behind his back. The boy was neither on drugs at the time nor did he have any signs of heart disease prior to the incident.

Taser International insists that their Taser guns are safe, non-lethal devices and that studies have proven that there is no danger of cardiac arrest if the device strikes an individual in the chest. In October 2009, despite these claims, the company recommended that officers not aim directly for the chest.

In addition, a 2008 report by Amnesty International found 334 deaths linked to the use of Taser guns between 2001 and August 2008.

For example, previously when a child turned 2 it was time for them to move to the next level, but now children are required to stay in their rear-facing seats if they are under the weight or height restrictions set forth by the car seat manufacturer. Similarly, once a child has graduated to the forward facing car seat, it is recommended they stay in that seat until it is outgrown.

The use of speed cameras, red-light cameras at intersections, and ignition interlocks for habitual drunk drivers have all helped to deter some of the bad driving behaviors that occur on American roadways but that still isn’t quite enough.

“While we’re looking for the next big breakthrough in vehicle safety, we should keep in mind that many existing strategies at the driver and passenger level still can yield gains,” says Adrian Lund, Institute President.
