The Final Part of a Personal Injury Trial

Charlotte, NC Personal Injury Lawyer

There are many components to a successful personal injury trial. This article discusses what happens after your Charlotte auto accident attorney has rested his case.

The Defense’s Turn

Once your Charlotte auto accident attorney has finished, it will be the defense attorney’s turn to present his or her case to the jury. At this time, the defense attorney may give an opening statement if he did not do so earlier. He will also have the opportunity to produce witnesses. Your attorney will get another opportunity to examine the defense witnesses during cross-examination, as well as provide rebuttal witnesses.

Closing Arguments

After both sides have argued their case, they will each have a chance to make their closing arguments to the jury. This is their final opportunity to summarize the evidence, point out discrepancies, and argue how the law applies in their favor.

Jury Instructions

After closing arguments, the judge will instruct the jury as to the relevant, controlling law in the jurisdiction. The attorneys will usually meet with the judge at the close of the evidence to discuss the jury instructions.

Jury Deliberations

After the jury instructions are read, the jurors will retire to the jury room to deliberate. At this time they will discuss the evidence, examine exhibits, and review testimony. Once the jury has reached a verdict, the foreperson will inform the bailiff.
