Will I have to go to court?

If you file a lawsuit, you will likely be deposed by a lawyer hired by the insurance company. This would normally happen at our office. We will conduct other depositions and discovery in which you may choose to be involved. Many lawsuits settle at mediation at the end of the discovery process before going to trial.

There are dozens of different judicial districts in our state, and many have a different system for setting trial calendars, so there is no way to know when your trial will be prior to our case being put on a calendar. Many times we will be put on a trial calendar, but the cases ahead of us for that trial week go forward, so our trial gets bumped to a later trial week several months later. Often it takes two years or more to complete a trial. In some judicial districts, we are only given three weeks’ notice before a trial date, but in some, we are given as much as six months’ notice. We will give you as much notice as possible when your case is set for trial.
